By using EveryDriver you agree to these terms. EveryDriver Ltd ("EveryDriver", "we", "us") operates a marketplace connecting learner drivers with approved driving instructors. EveryDriver acts as a booking and introduction agent — driving lessons themselves are provided by independent, DVSA-approved instructors.

1. Pricing & VAT

All prices displayed on EveryDriver are in GBP and inclusive of VAT at the prevailing UK rate where applicable. Where an instructor is not VAT registered, the price shown is the total payable. We reserve the right to correct pricing errors before a booking is confirmed.

2. Bookings, Deposits & Balance Payments

A deposit is processed at the time of booking to secure your instructor and course dates. The remaining lesson fees are paid directly to your instructor unless otherwise stated. A booking is only confirmed once payment has cleared and you receive a written confirmation from EveryDriver.

3. Instructor Responsibilities

Instructors listed on EveryDriver are independent contractors, not employees of EveryDriver. Each instructor is responsible for:

• Holding a current DVSA ADI (or PDI) licence and displaying their badge
• Maintaining valid insurance, MOT and roadworthiness of their tuition vehicle
• Delivering lessons safely, professionally and in line with the DVSA syllabus
• Issuing refunds for lessons not delivered through their own cancellation

4. Pupil Responsibilities & Practical Test

Pupils are responsible for holding a valid UK provisional (or full) driving licence, passing the DVSA theory test before booking a practical test, and arriving on time, fit to drive (not under the influence of alcohol, drugs or medication that impairs driving). EveryDriver and your instructor reserve the right to refuse a lesson or test where this is not the case; no refund is due in such circumstances.

5. Free Re-Test Guarantee Conditions

Where a "free re-test" is included with a course, it is subject to the conditions set out in our Returns & Refund Policy: the pupil must have completed all booked lessons, the re-test covers the DVSA practical test fee only, must be claimed within 6 months of the failed first attempt, and is limited to one re-test per booking.

6. Minimum Age & Safeguarding

The minimum age for booking lessons is 17 (16 for pupils in receipt of the enhanced rate mobility component of PIP). Pupils under 18 must have a parent or legal guardian's consent before booking. EveryDriver and our instructors operate a safeguarding policy: any disclosure of harm or risk will be reported to the relevant authorities in line with UK safeguarding law.

7. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or to harass instructors, staff or other pupils
• Post false, defamatory or misleading reviews
• Attempt to circumvent the platform to avoid booking fees
• Scrape, copy or reproduce platform content without written permission

We may suspend or terminate accounts that breach these rules.

8. Platform Availability

We aim to keep EveryDriver available 24/7 but do not guarantee uninterrupted access. We may suspend the service for maintenance, security or operational reasons. We are not liable for losses arising from temporary unavailability of the platform.

9. Changes to These Terms

We may update these terms from time to time. Where changes are material we will give at least 14 days' notice by email or via a prominent notice on the platform before they take effect. Continued use after the notice period constitutes acceptance.

10. Buy Now Pay Later (Klarna / Clearpay)

Where you choose to pay by Klarna or Clearpay, your credit agreement is with the BNPL provider, not EveryDriver. You are responsible for meeting the repayment schedule agreed with that provider. Refunds processed by EveryDriver will be returned to your BNPL account and your plan adjusted by the provider.

11. Intellectual Property

All trademarks, logos, copy, designs, photography and software on EveryDriver are owned by EveryDriver Ltd or our licensors. You are granted a limited, non-exclusive licence to access the platform for personal, non-commercial use only. You may not reproduce, modify or redistribute our content without prior written consent.

12. EverySwap

EverySwap is a free peer-to-peer service helping pupils exchange DVSA practical test slots. EveryDriver does not arrange, control or guarantee the DVSA test booking transfer. Any transfer fees charged by the DVSA are the pupil's responsibility. EveryDriver accepts no liability for failed transfers, lost tests or any related loss.

13. Cancellations & Refunds

Cancellation rights, deposit terms and refund timescales are set out in full in our Returns & Refund Policy, which forms part of these terms.

14. Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law. Subject to that, our total liability arising from a booking is limited to the fees paid to EveryDriver for that booking.

15. Data, ICO Registration & PCI DSS

EveryDriver Ltd is registered with the UK Information Commissioner's Office (ICO) as a data controller. Our handling of personal data is described in our Privacy Policy. Card payments are processed by PCI DSS compliant payment providers; EveryDriver never stores raw card numbers on our own servers.

16. Governing Law

These terms are governed by the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction over any dispute.
